On Tuesday arrived from England the Ann transport, Captain Clarke, with a part of the 73d Regiment; and 197 male prisoners, having lost one overboard on the passage, whose name was Pope. These people are in a healthy state; and express the highest satisfaction at their treatment on the passage. The Military Officers arrived are Captain Maclean; Lieutenants Purcell and Drury, and Assistant Surgeon Martin, the three latter gentlemen accompanied by their Families. Article* | 14 October 1844 | "The Australian", Sydney, NSW; Court of Requests, Oct. 5.—This Court opened a little after ten o'clock, before Mr. Commissioner Therry, with upwards of seventy causes on the £10 list for adjudication; but none of which were of sufficient interest for remark. There were only five cases on the extended jurisdiction list, which commenced about three o'clock, when R. C. Lethbridge and Henry Cox, Esqrs., J P. were sworn Assessors. James Ryan v. Charles Purcell, £30 damages. Mr. Lambton appeared for the plaintiff: Mr. Lyons for the defence. The following is an outline of the nature of claim, as set forth by Mr. Lambton: that the plaintiff is a butcher residing at Penrith; in the month of May last he had purchased from the defendant a herd of fat bullocks, on the Mountains, and had paid earnest money for the same, a condition being agreed to, between the parties that the defendant should keep the cattle one day for the plaintiff, at which time he would pay for, and receive them from the defendant; the complainant subsequently tendered payment in a cheque on the Bank to defendant, who refused delivering them up, stating that the time had elapsed, and also questioning the nature of the payment, and subsequently sold the cattle at an advance upon the sum agreed to in the prior purchase by Ryan. The complainant contended that he had a right in the first instance to a full day of 24 hours; and secondly, that his cheque having never been dishonored was a legal tender. Mr. James Nairn, innkeeper, on the Mountain Road, examined—Knew the plaintiff and defendant; recollected their being at his inn on the 29th of May last; saw earnest money paid by Ryan to Purcell, for a lot of cattle Ryan had purchased from him; Ryan wished Purcell to keep the cattle one day, which Purcell agreed to; he was to keep them one clear day after they were down off the mountains. Mr. Wm. Piesley, butcher, of Parramatta, examined—Knows the parties in the present action; recollects a transaction between Ryan and Purcell, about a sale of cattle, in May last; recollects a cheque being tendered by Ryan to Purcell, as the purchase-money, a day only having elapsed between the tender of the cheque and the bargain being made; Purcell refused to take the cheque or to deliver the cattle, until he saw Mr. Purcell, senior, his father; did not deliver the cattle at all, but sold them subsequently to another person, at an advanced, price. Mr. Perry, landlord, of the Rose inn, the plaintiff, and also Mr. Purcell, senior, were likewise examined — the two former in direct support of the case, and the latter for the defendant. His Honor the Commissioner then addressed the Assessors at some length, minutely recapitulating the evidence on both sides, and leaving the case in their hands on the merits. The Assessors found a verdict for the plaintiff, damages £30 and costs.23 |
