Probate* | 9 November 1900 | NSW; Mary Jane Clark 21541 Clark, Mary Jane late of Demondrille Widow This is the last Will and Testament of me Mary Jane Clarke of Demondrille near Murrumburrah in the Colony of New South Wales Widow I appoint James Edwin Gordon and James Lyons both of Demondrille aforesaid Farmers to be the Executors and Trustees of this my Will I give devise and bequeath unto my daughter Alice Clark and my granddaughter Alice Shea as tenants in common All that piece or parcel of land situate at Murrumburrah Parish of Murrumboola County of Harden containing about Two roods and being part of allotment eight section two Next I give devise and bequeath unto my said daughter Alice Clark one moiety or half of my selections being Conditional Purchase numbers 73.485, 73.486, 73.531 and 75.265 taken up at Young and I give devise and bequeath the balance or the other moiety of my said Selections to my Trustees their heirs executors administrators and assigns In trust for my daughter Norah Clark wife of James Clark for her life and from and after her decease in trust for the children of the said Norah Clark who shall then be living as tenants in common But I direct my said Trustees if my said daughter Norah Clark shall direct them in writing so to do to lease her portion of the said Selections for any term or terms not exceeding five years and to pay to her the rent derived from such leasing or if she shall direct them as above to sell the same and pay the proceeds of such sale into the Government Savings Bank and pay the interest derived from such investment to her for life and from and immediately after her death to divide the same equally between her said children paying the share or shares of such child or children who shall have arrived at the age of twenty one years to them at once and to pay the balance into the Government savings bank and use the proceeds towards the maintenance and education of her said infant children but as each one arrives at the age of twenty one years to draw his or her share and pay it to him or her I give devise and bequeath the whole of the residue of my real and personal estate of whatsoever kind and wheresoever situate unto my said Trustees in trust as soon as convenient after my decease to sell and convert the same into money and pay all my just debts funeral and testamentary expenses and divide the balance (if any) equally between my said daughters Alice and Norah Clarke And I direct that in case of any child of my said daughter Norah Clark dying before arriving at the age of twenty one years without lawful issue and unmarried his or her or their share or shares shall be equally divided amongst the survivors of her said children dying before my said daughter Norah Clark and having lawful issue I direct that the share of each child so dying shall go to and be equally divided the children of such child I appoint my said Trustees and Executors or the survivor of them guardians or guardian of the said infant children of my said daughter Norah Clarke for the purposes of this my Will I revoke all former Wills and declare this to be my last Will and Testament In witness whereof I have hereunto set my hand this twenty seventh day of May in the year of Our Lord one thousand eight hundred and ninety six Mary Jane Clark (her mark) Signed “by affixing her mark” by the said Mary Jane Clark the Testatrix as and for her last Will and Testament “the contents thereof having been read over and explained to her and she appeared to fully understand the same” in the presence of us present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses James Gordon G.
