This is the last Will and Testament of me Henry Mann of 19 Castle Road in the Town and County of Bedford Gentleman I hereby revoke all former Wills and testamentary dispositions made by me and declare this to be my last Will and Testament I appoint my Wife Elizabeth John Frederick Monk of 75 Bower Street in Bedford aforesaid Butcher and Charles Bailey Halliley of Bedford aforesaid Solicitor and his son Charles Elton Halliley in place of the said Charles Bailey Halliley should the latter be deceased at the time of my death (hereinafter called my Trustees) to be the Executors and Trustees of this my Will I bequeath to my eldest Son Henry Thomas William Mann or to his Wife if he shall predecease me my gold Watch and Chain Family Bible and any photographs prints pictures or framed needlework the latter being his mother’s own work that he (or she as the case may be) may select from such articles as are in my possession at my decease I bequeath the legacies following to be paid respectively free from legacy duty that is to say To the said John Frederick Monk if he should prove my Will and act in the execution of the trusts thereof the sum of Fifteen pounds as an acknowledgement for his trouble in executing the office of Trustee of this my Will To my Son Frederick Robert Mann the sum of Fifty pounds and to my Son Edmund Griffin Mann the sum of Seventy five pounds but I declare that any advancement of sums of money subsequent to this date to the amount at any one time of twenty pounds or more respectively which I make of apply for the benefit of my said Sons Frederick Robert Mann and Edmund Griffin Mann shall be in satisfaction either pro tanto or in toto of their respective legacies here by bequeathed And I declare that such legacies shall be primarily payable out of my ready money and out of dividends or income of any stock or shares or other investments whatsoever to which I shall be entitled at the time of my decease and if after payment of my just debts (other than mortgage debts) and my funeral and testamentary expenses and of the afore mentioned legacies out of such funds as aforesaid my Trustees shall then have a balance in hand remaining of such funds as aforesaid such balance shall be paid by them in the following manner as two equal third parts to my said Wife Elizabeth and as to the remaining one equal third part thereof to my Daughter Ada Emily but if such funds shall in insufficient for the payment of the legacies then the said legacies or sums to my said Wife Elizabeth and my Daughter Ada Emily shall abate and [new page] the remainder of all other legacies hereinbefore bequeathed shall be paid in manner hereinafter provided I devise and bequeath all my real estate and the residue of my personal estate and effects not otherwise disposed of by my Will unto my Trustees their executors administrators and assigns Upon trust that my trustees or the survivors or survivor of them or other the Trustees or Trustee for the time being of my Will shall sell call in and convert into money the said real (with the exception as to my dwellinghouse 19 Castle Road aforesaid hereinafter provided) and personal estate and premises and shall hold the proceeds of such sale and conversion upon the trusts hereinafter declared of the same And I declare that as to my freehold messuage or dwellinghouse Number 19 Castle Road aforesaid my Trustees shall hold the same Upon trust to permit the same together with the fixtures furniture and all household effects to occupied jointly by my said Wife Elizabeth and my Daughter Ada Emily or by the survivor of them so long as they shall think proper without payment of rent they or she paying the rates and taxes payable in respect of the same and keeping the said dwellinghouse and furniture and household effects as aforesaid in a proper state of repair Provided always if my said Wife Elizabeth or my Daughter Ada Emily shall not so desire to reside at such dwelling house as aforesaid then and in such case the other shall be permitted to reside therein and shall pay a rent of twenty pounds per annum to my Trustees and if neither of them my said Wife Elizabeth or my Daughter Dad Emily shall so reside at such dwelling house then I direct that my Trustees may at their discretion let the same during the joint lives of my said Wife Elizabeth and my Daughter Ada Emily either as furnished apartments or unfurnished and provided always that no furniture shall be removed from such dwellinghouse without the consent in writing of my Trustees or they may sell the same by Public Auction or Private Contract at their direction and invest the proceeds and hold same under the trusts of this my Will I declare that if in any year after my decease the profits from my trust estate should be less in amount than One hundred and twenty pounds then in such year I devise that my Trustees shall pay to my Widow a minimum of Thirty pounds (she having an income of upwards of Twenty pounds per annum of her own) And to my Daughter Ada Emily Mann a minimum sum of Fifty pounds in any such year (she being an invalid and having no private means of her own) And I direct that such sums shall be paid by my said Trustees out of any funds which [new page] they may have available and if necessary they may resort to capital to realise such payments And I further direct that if from any cause whatsoever my said Daughter should be left without the care and assistance of my Widow in my house as aforesaid or that from any cause my said Daughter shall reside elsewhere then and in such case I direct that my Trustees shall have discretionary powers to increase her annual allowance to such sum as they deem to be necessary for keeping an attendant to look after her wants And that my Trustees shall have absolute discretion to raise all such necessary funds from income or capital as the circumstances may require. And in the event of my said Daughter residing at Number 19 Castle Road aforesaid without the companionship of my Widow I revoke the clause in my will charging her with the payment of rent for such occupation and in substitution of the direction therein contained I direct that she may be allowed to do so rent free and also free from the cost of repair insurance rates and taxes And in the event of her living elsewhere my said Trustees at their discretion may allow her free of charge from Number 19 Castle Road the use of such portion of the furniture (besides the piano and other articles which are her own property) as they may think expedient without leaving the house denuded of furniture and unfit to let as a furnished house And in the event of my Daughter predeceasing my Widow I give my said Trustees the power to wind up my estate subject to the provision of an annuity of Forty pounds for my said Widow And I further declare that prior to winding up my estate my said Trustees shall offer to the four families or their representatives who are my residuary legates living at that time in equal proportions All articles of plate china glass linen prints photographs books timepieces clothing bedding or other small articles being sold as part of my estate Provided always that my Trustees or Trustee my in their or his absolute and uncontrolled postpone the sale calling in and conversion of my real and residuary personal estate or any part thereof for such time as they or he shall think fit without being answerable for loss And I declare that until such sale or conversion the rents profits and income arising from such part of my real and residuary personal estate as shall for the time being remain unsold and unconverted shall be paid or applied by my Trustees or Trustee upon the [new page] Trusts to the persons or person for the purposes and in manner to whom and for and in which the dividend interest and income arising from the investment of the proceeds of sale of my real and residuary personal estate would have been payable or applicable under the trusts hereinafter declared concerning the same And I declare that my Trustees or Trustee shall at their or his discretion invest the moneys to arise from the sale calling in and conversion of real and my residuary personal estate And any Trust moneys that may come to their hands in their or his names And I further declare that my Trustees or Trustee shall stand possessed of and interested in the said proceeds of the sale and conversion of my real and residuary personal estate and the stocks fund and securities of which the same shall consist or in or upon which the same shall from time to time be invested (hereinafter called the residuary Trust fund) and the annual proceeds and income thereof Upon the trusts for the purposes and with and subject to the powers and provisions hereinafter expressed concerning the same that is to say: Upon trust that my Trustees or Trustee shall after payment of all outgoings in respect of my said property including the interest due on any Mortgages pay to my said Wife Elizabeth or permit her to receive one equal third part or share of the income of the said trust fund during her life for her sole and separate use and shall pay to my Daughter Ada Emily one equal third part or share of the income of the said trust fund for her life and as to and as to the remaining one equal third part in share of the income of the said trust fund shall stand possessed of and accumulated the same by way of compound interest by investing the same and all the resulting income thereof from time to time in or upon adequate security until the same shall be sufficient to pay the remainder of the pecuniary legacies hereinafter bequeathed remaining unpaid (if any) such payments to be free from legacy duty as aforesaid And from and after such payment then upon trust to pay the said one equal third part or share of income unto between or among all of my children being Sons or Daughters of mine as shall survive me and in the event of any Son or Daughter 0f mine predeceasing me then any of his or her children shall collectively take only the share which such deceased child of mine would have taken if living And from and after the decease of my said Wife Elizabeth or my Daughter Ada Emily Upon trust to pay such one equal third part or share of income herein before bequeathed to my said Wife and Daughter respectively equally among all of my children [new page] being Sons or Daughters of mine as shall survive me And in the event of any Son or daughter of mine predeceasing me then any of his or her children shall collectively take only the share which such deceased child of mine would have taken if living And from and after the decease of my said Wife Elizabeth and my Daughter Ada Emily and the survivor of them Upon trust to pay transfer or divide the said trust fund to between or among the following persons namely To my Son Henry Thomas William Mann or to his Wife and his children who shall be living at his decease one equal fourth part or share thereof To my Son Frederick Robert Mann or to his Wife and his children (if any) who shall be living at his decease one equal fourth part or share thereof To my Son Edmund Griffin Mann or to his Wife and his children (if any) who shall be living at his decease one equal fourth part or share thereof and To my two Grandchildren Mabel Edith Horne and Roland Cecil Horne the children of my deceased daughter Isabella Maria Horne one equal fourth part or share thereof And I declare that the said Charles Bailey Halliley or his Son the said Charles Elton Halliley in the transaction of any business or in any act required to be done in connection with the administration of my estate or of the trusts of my said Will therein declared including the receipt and payment of money shall be entitled charge and be paid all professional charge for any business or act done by him
