I Edward Man the Elder of Harbury in the County of Warwick Gent being of perfect and sound mind and memory praise be therefore given to Almighty God for the same to make and ordain this my present last Will and Testament in manner and form following (that is to say) first and principally I comend my soul into the hands of Almighty God hoping thro the meritorious death and passion of my blessed Saviour Jesus Christ to have full and free pardon and forgiveness of all my Sins and to inherit everlasting life And my body I committ unto the Earth to be decently buried by my Executor here after named And as to for touching and concerning the disposition of all such temporall Estate as it hath pleased Almighty God to intrust me with I give and dispose thereof as followeth Imprimis my will and desire is that debts and funeral charges shall be first paid and discharged And my Will and desire is to be buried in the Church Yard of Harbury aforesaid And as near my former Relations as conveniently may be and also that my said Executor doth lay out dispose in about and upon my funeral Expenses the sume of Twenty pounds of lawfull money of Great Britain Item I give and bequeath after the decease of Mary Man of Kenelworth in the County of Warwick Widow unto my Grandson Edward Man Son of Edward Man of Harbury aforesaid Yeoman his Heirs and Assigns for ever All that Messuage or Tenement Close Barns Stables Gardens Orchard thereunto belonging with their appurtenances scituate and be in Harbury aforesaid Together also with three Yard Land to the said Messuage or belonging Together also with all Comons and Comon of Pasture and all other profits and advantages whatsoever thereunto incident and belonging lying and being dispersedly in the open and common fields of Harbury aforesaid now in the tenure or occupaton of one Job Radford or his Assigns And also that Cottage or Tenement Close Barn and Orchard with their appurtenances And also all that Quartern of a Yard Land Together with all Comons profits and advantages whatsoever thereunto belonging lying and being dispersedly in the open and common fields aforesaid and now in the occupation of one Griffen Fennell or his Assignes To have and to hold the said Messuage or Tenement Cottage or Tenement three Yard Land and one Quartern of a Yard Land and all and singular other the said premises with their appurtenances unto the said Edward Man his heires and Assigns for ever and to and for none other use intent or purpose whatsoever Item I give devise and bequeath unto my Grandson Thomas Man the Eldest Son of Edward Man of Harbury aforesaid Yeoman his Heires and Assignes for ever he the said Thomas Man paying unto his Sisters Mary Man and Hester Man the sume of Two hundred pounds of lawfull money of Great Britain when they shall attain to the Age of Eighteen years All that Messuage and Tenement and premises with their appurtenances thereunto belonging scituate and being in Southam in the said County of Warwick Together with a Yard Land to the said Messuage or Tenement belonging and all Comons and Comon of Pasture and all other profits and Advantages whatsoever thereunto belonging lying and being dispersedly in the open and common fields of Southam aforesaid and now in the tenure and occupation one John Bradfield his Assigns or Undertenants And also All that Cottage or Tenement and premises with the appurtenances scituate and being in Southam aforesaid and now in the tenure or occupation of one John Newcombe or his Assigns To have and to hold the said Messuage or Tenement Cottage or Tenement and all and singular other the said premises with their appurtenances herein before given devised and bequeathed unto the said Thomas Man and his Heirs and Assignes and to and for none other use intent or purpose whatsoever Item I give devise and bequeath unto John Man Third Son of Edward Man of Harbury aforesaid Yeoman and his Heires and Assignes for ever after the decease of Mary Man Widow as aforesaid All that Messuage or Tenement Barn Stable Garden Orchard and Close thereunto belonging with their appurtenances scituate and being in Harbury aforesaid Together with three Yard Lands to the said Messuage or Tenement belonging and also all Comons and common of Pasture and all other profitts and advantages notsoever thereunto incident and belonging scituate lying dispersedly in the open and common fileds of Harbury aforesaid now in the tenure or occupation of one John Turbite or his Assignes To have and to hold the said Messuage or Tenement Three Yard Land and all and singular other the said premises with their appurtenances unto the said John Man his Heires and Assignes for ever and to and for none other use intent or purpose whatsoever Item I give devise and bequeath unto Mary Bond one of the daughters of Symon Bond of Harbury aforesaid Mason the sume of forty pounds of lawfull money of Great Britain to be paid her within one year after my decease Item I give devise and bequeath unto Anne Bond another of the daughters of Symon Bond of Harbury aforesaid Mason the sume of Thirty pounds of lawfull money of Great Britain to be paid unto her within one year after my decease Item I give and bequeath unto Mary Man one of the daughters of Richard Man of Harbury in the aforesaid County Chandler the sume of Twenty pounds of lawfull money aforesd to be paid her within one year after my decease Item I give devise and bequeath unto William Man one of the Sons of Richard aforesaid the sume of Ten pounds of the like lawfull money to be paid him within one year after my decease Item I give devise and bequeath unto Mark Man another of the Sons of Richard Man aforesaid the sume of Ten pounds of lawfull money of Great Britain to be paid him within one year after my decease Item I give devise and bequeath after the decease of Mary Man of Kenelworth Widow as aforesaid unto my Grandaughter Mary Man one of the daughters of Edward Man of Harbury in the aforesaid County Yeoman and to her Heires of her body lawfully begotten for ever All that Messuage or Tenement and Home Close and one Quarter of a Yard Land together with all Comons profitts and Advantages whatsoever thereunto belonging lying and being dispersedly in the open and common fields of Harbury as aforesaid and now in the tenure or occupation of one Anthony Mayo But if in Case the said Mary Man shall do part this life without issue of her body lawfully begotten that then the said Cottage or Tenement and Quarter of one Yard Land with the appurtenances thereunto belonging shall return to Edward Man and his Heires for ever as aforesaid Item I give devise and bequeath after the decease of Mary Man of Kenelworth Widow aforesaid unto my Grandaughter Hester Man one of the daughters of Edward Man of Harbury in the aforesaid County Yeoman and to her Heires of her body lawfully begotten for ever All that Messuage or Tenement and the appurtenances thereunto belonging And also one Quarter of a Yard Land Together with all commons profitts and advantages whatsoever thereunto belonging lying and being dispersedly in the open and common fields of Harbury as aforesaid now in the tenure or occupation of one John Odel or his Assignes But if in Case the said Hester Man shall depart this life without Issue of her body lawfully begotten that then the said Messuage or Tenement and Quarter of One Yard Land with the appurtenances thereunto belonging shall returne to Edward Man as aforesaid and his Heires for ever Item I give unto William Makepeace of Flecknoe in the said county of Warwick Item I give unto William Makepeace of Flecknoe in the said county of Warwick Yeoman the sume of Ten pounds of lawfull money of Great Britain to be paid within one year of my decease Item I give and bequeath unto James Hamp one of the Sons of John Hamp of Harbury in the aforesaid County Blacksmith the sume of Ten pounds of lawfull money as aforesaid to be paid him within one year after my decease aforesaid to be paid him one year after my decease Item I give unto John Hamp another of the Sons of John Hamp as aforesaid the sume of Ten pounds of the like lawfull money as aforesaid to be paid to him within one year after my decease Item I give unto Anne Hamp daughter to John Hamp as aforesaid the sume of Ten pounds of lawfull money as aforesaid to be paid her within one year after my decease Item I give devise and bequeath unto my Grandaughter Hester Man of Harbury as aforesaid and her Heires Assignes for ever All that Messuage or Tenement and premises with their appurtenances scituate standing and being in the High Street or high Pavement in the Borough of Warwick in the County of the same now in the occupation of one Bernard Shepherd or his Assignes To have and to hold the said Messuage or Tenement and premises with their appurtenances unto the said Hester Man and her Heires for ever and for none other use or intent whatsoever Item I give unto Robert Man of Ward in the County of the same Taylor the sume of five pounds of lawfull money of Great Britain to be paid to him within one year after my decease Item I give unto Edward Pen of Welsbourne in the aforesaid County the sume of five pounds of the like lawfull money to be paid him within one year of my decease Item I give unto Anne Hough the Wife of Ed Hough of Harbury aforesaid the sume of Six pounds of the like lawfull money to be paid her within one year after my decease Item I give devise and bequeath unto my Grandaughter Mary Man of Harbury as aforesaid All that Messauge or Tenement and premises with their appurtenances scituate standing and being in the High Street or high Pavement in the Borough of Warwick in the County of the same and now in the occupation of one Jones a Sadler or his Assignes To have and to hold the said Messuage or Tenement and premises with their appurtenances unto the said Mary Man and her Heirs for ever and to none other use intent or purpose whatsoever Item my Will is All that Messuage or Tenement and premises with their appurtenances scituate standing and being in the High Street or high Pavement in the Borough of Warwick as aforesaid in the occupation of Mr Makepeace shall be sold within one year after my decease and the money which the aforesaid Messuage or Tenement shall be sold for I give and bequeath to Martha Radford the Wife of Job Radford or Harbury aforesaid the sume of Twenty pounds And the sume of Twenty pounds apiece to my Grandsons Edward Man and John Man the Sons of Ed Man as aforesaid and unto my Grandsons Richard Man and William Man and Edward the Sons of Richd Man Chandler as aforesaid the sume of Twenty pounds apiece and to Mark Man one of the Sons of Richard Man aforesaid the sume of Twenty pounds And to Mary Man the daughter of Richard Man aforesaid the sume of Ten pounds And to Mary Bond and Sarah Bond the daughters of Symon Bond the sume of twenty pounds apiece Item to Mary the Wife of Edward Man and to Sarah the Wife of Simon Bond and to Anne Hamp the Wife of John Hamp and to Martha the Wife of Job Radford the sume of five pounds apiece and the Overplus which the said Messuage or Tenement shall be sold for the Legacy’s first paid to be disposed and given among the poorest of my Relations as my Overseers and Executor shall think fitt Item I give and bequeath unto Mary Radford the daughter of Job Radford of Harbury the sume of Twenty pounds of lawfull money of Great Britain which is now in the hands of my Executor and to be sett out to Intrest within one year after my decease until she attains to the Age of one and twenty years for and towards raising a portion for the said Mary Radford and to be paid her at the Age aforesaid Item I give and bequeath unto Thomas Man the Eldest Son of Edward Man of Harbury aforesaid and his heires for ever after the decease of Mary Man of Kenelworth in the County of Warwick Widow All that Messuage or Tenement and appurtenances thereunto belonging and Quarter of a Yard land Together with all Comons profitts and advantages whatsoever thereunto belonging lying and being dispersedly in the open and common fields of Harbury as aforesaid and now in the tenure or occupation of John Palmer or his Assigns To have and to hold the said Messuage or Tenement and one Quartern of one Yard Land and all singular other the said premises with their appurtenances unto the said Thomas Man and his heires for ever and for none other use and intent whatsoever Item I give and bequeath unto my Son Edward Man and Mary his Wife after my decease during their naturall lives All that Messuage or Tenement and premises in the said Borough of Warwick and now in the occupation of one Bullock or his Assigns And after the decease of Edward Man and Mary his Wife I give and bequeath the said Messuage or Tenement and premises unto my three Grandsons Thomas Man and Edward Man and John Man the Sons of Edw Man of Harbury aforesaid to be equally divided amongst them Item my debts and Legacies above mention’d my Will is that they shall be justly and honestly paid and discharged as aforesaid Item I do ordain and appoint Edward Sabin and James Lamprey both of Harbury in the aforesaid County Overseers of this my last Will and Testament and for their just care to see the same performed I do give to oath of them Ten Shillings apiece to be paid them by my Executor hereafter named Item my Will is that if in case the said Mary Man or Hester Man daughters of the said Edward Man of Harbury aforesaid or either of them shall depart this life before they or either of them shall be married that then the Houses in Warwick given to them shall returne amongst the three Sons of Edward Man of Harbury aforesaid to be equally divided share and share alike Item my Will is that Edward Sabin and James Lamprey do take care to see my Grandaughters married to such Men as they shall think may have good and sufficient Jointures answerable to their portions And Lastly I do make my Son Edward Man of Harbury aforesaid sole Executor of this my last Will and Testament and I do hereby revoke disannull and make void all former Wills at any time by me hereunto made In Witness whereof I the said Edward Man have hereunto sett my hand and Seal the Tenth day of July And in the Ninth year of the Reign of our Soveraign Lady Anne Queen over Great Britain And in the year of our Lord God One Thomas Hall of Southam in the County of Warwick Salesman maketh Oath that he this deponent was sent for by Edward Man the Elder late of Harbury in the County of Warwick Gent deceased to Harbury aforesaid in order to take instructions to draw and ingross his the said Edward Mans last Will and Testament which said Will this deponent did engrosse accordingly and after the engrossing thereof did read the said Will to the Testator the said Edward Man which the said Edward Man approved to be in every respect according to his instructions and desire and did execute the said Will on or about the Tenth day of July in the year of our Lord one Thousand Seven hundred and ten which said Will is hereto annexed and some time after the executing of the said Will the Testator sent for this deponent to him to Harbury aforesaid and desired this deponent to read his said Will over to him which this deponent did accordingly And in reading the said Will when this deponent had read to such and such Legacies as hereafter mentioned the Testator ordered this deponent to make such and such rasures as hereafter particularly named (Viz) To Mary Bond one of the daughters of Simon Bond of Harbury aforesaid Mason the sume of forty pounds of good and lawfull money of Great Britain to be paid her within one year after my decease which said Legacy the Testator told this deponent he had already paid her the said Mary Bond in his life time And then the said Testator ordered this deponent to read on farther To a Legacy given in the said Will to William Makepeace for that he the said Testator had already paid the same to the said Makepeace And then the testator ordered this deponent to read on farther until he came to a Legacy given in the said Will to Robert Man of Warwick in the said County Taylor of five pounds which said Legacy the Testator ordered this deponent to rase but having also paid the same And then the testator ordered this deponent to read on farther until he came to a Legacy given in the said will to Edward Pen of Wellesbourne of five pounds which last mentioned Legacy the Testator also ordered this deponent rase out having also paid that Legacy in his life time And then the Testator ordered this deponent to read on farther until he came to a Legacy given in the said Will to Anne Hough the wife of Edward Hough of Harbury aforesaid Butcher of Six pounds which last mentioned Legacy the Testator ordered this deponent to rase out Then the Testator ordered this deponent to read on farther until he came to the Testators Grandsons Richard Man William Man Edward Man and Mark Man and then the Testator ordered this deponent to rase out these four to whom the Testator had bequeathed four Legacies of Twenty pounds apiece And then the Testator ordered this deponent to read on farther until he came to Sarah Bond and Mary Bond the daughters of Symon Bond of Harbury aforesaid to whom the Testator had given Twenty pounds apiece and then the Testator ordered this deponent to rase out the Legacies given to the said Sarah Bond and Mary Bond all which rasures and alterations were made and altered by the order and direction of the said Testator and in his presence
